1. קבלת התנאים

בכניסה לפלטפורמת ERRA Analytics ("השירות") או בשימוש בה, המופעלת על ידי ERRA LTD ("החברה", "אנחנו"), אתה מסכים להיות כפוף לתנאי שימוש אלה ("התנאים"). אם אינך מסכים לכל התנאים, אינך רשאי לגשת לשירות או להשתמש בו.

תנאים אלה חלים על כל המבקרים, המשתמשים ואחרים שניגשים לשירות או משתמשים בו, כולל תוכניות מנוי בתשלום.

2. הגדרות

  • "Service" - the ERRA Analytics web application, including all pages, features, data, analytics tools, AI-powered tools, APIs, and related services.
  • "User" / "You" - any individual or entity that creates an account and uses the Service.
  • "Subscription" - a paid plan that grants access to premium features for a specified billing period.
  • "Content" - data, text, reports, analytics, and other materials generated by or available through the Service.
  • "Paddle" - Paddle.com Market Limited, our merchant of record for payment processing.

3. Account Registration

To use the Service, you must register for an account by providing accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately if you become aware of any unauthorized use of your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By registering, you represent that you meet this requirement.

4. Subscriptions & Billing

4.1 Plans

The Service offers multiple subscription tiers (Starter, Professional, Enterprise) billed on a monthly or annual basis. Current pricing is displayed on our Pricing page.

4.2 Payment Processing

All payments are processed by Paddle, which acts as the merchant of record for all transactions. By purchasing a subscription, you also agree to Paddle's Terms of Use and Privacy Policy.

4.3 Billing Cycle

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date. You will be charged at the beginning of each billing cycle.

4.4 Price Changes

We reserve the right to change subscription prices with at least 30 days' written notice via email. Price changes will take effect at the start of the next billing cycle following the notice period.

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period.
  • No further charges will be made.
  • Your account will revert to free-tier access after the billing period ends.

5. Free Trial

We may offer a 7-day free trial for new users. During the trial period, you will have full access to the selected plan's features. At the end of the trial:

  • If you provide payment details and do not cancel, your subscription will begin and you will be charged.
  • If you do not provide payment details, your account will revert to free-tier access.

The free trial is limited to one per user/household. We reserve the right to revoke or decline trial access at our discretion.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated systems (bots, scrapers) to access the Service beyond authorized API usage.
  • Resell, redistribute, or sublicense access to the Service without our written permission.
  • Upload or transmit any malicious code, viruses, or harmful content.
  • Use the AI-powered tools to generate content that is illegal, harmful, or misleading.

7. Intellectual Property

7.1 Our Property

The Service, including its design, software, text, graphics, logos, and all associated intellectual property, is owned by ERRA LTD and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it as described herein.

7.2 Your Data

You retain ownership of any data you input into the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.

7.3 Generated Reports

Reports and analytics generated by the Service using your data are yours to use for your own business purposes. However, the underlying algorithms, models, and methodologies remain our intellectual property.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • The data, analytics, or AI-generated content will be accurate, complete, or reliable.
  • Any particular investment outcome will result from using the Service.

The Service does not constitute financial, investment, legal, or tax advice. Always consult qualified professionals before making investment decisions.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ERRA LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.

11. Termination

We may suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination:

  • Your right to use the Service will immediately cease.
  • We may delete your account and associated data after a reasonable retention period (30 days), unless retention is required by law.
  • Any outstanding fees remain payable.

12. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.
